1. The service
Qwik provides software intended to help commerce teams organize creator discovery, affiliate collaboration workflows, product matching, operational follow-up, and related performance information. Features may depend on integrations with third-party platforms and on the scopes and permissions those platforms approve.
2. Eligibility and authority
You must have legal capacity to enter into these Terms and, if acting for an organization, authority to bind that organization. You may connect only accounts, shops, and data that you are authorized to access and manage.
3. Accounts and security
You are responsible for maintaining accurate account information, protecting credentials, restricting account access to authorized users, and promptly notifying us of suspected compromise. You may not share credentials in a way that circumvents user controls or platform authorization requirements.
4. Third-party platforms
Qwik may interoperate with TikTok Shop and other third-party services. Those services are governed by their own terms, developer policies, privacy practices, availability, and technical restrictions. You must comply with the rules that apply to your use of each connected platform. We do not control and are not responsible for changes, suspensions, or outages of third-party services.
5. Authorized data use
You may use data accessed through Qwik only for lawful business purposes consistent with the authorization and platform rules under which that data was obtained. You may not use Qwik to scrape, reconstruct, resell, broker, deanonymize, improperly enrich, or exploit protected platform data, or to circumvent platform access controls.
6. Acceptable use
You agree to follow our Acceptable Use Policy. Among other restrictions, you may not use Qwik for unlawful activity, harassment, spam, unauthorized automated access, credential theft, security testing without permission, or conduct that violates a connected platform’s rules.
7. Intellectual property
Qwik, including its software, interface, design, documentation, and original content, is owned by Point One Percent LLC or its licensors and is protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service during your authorized subscription or access period. You retain rights in content and data you lawfully provide to Qwik.
8. Feedback
If you provide product feedback or suggestions, you grant us permission to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
9. Fees
Paid plans, when offered, will be subject to the pricing and billing terms shown at purchase or in an applicable order form. Taxes may apply. Beta or evaluation access may be changed or discontinued.
10. Confidentiality
Each party may receive non-public business, technical, or commercial information from the other. The receiving party will use reasonable care to protect confidential information and use it only for the relationship contemplated by these Terms, except where disclosure is required by law.
11. Suspension and termination
You may stop using Qwik at any time. We may suspend or terminate access if reasonably necessary to protect the service, users, connected platforms, or third parties; to comply with law or platform requirements; or in response to a material breach. Upon termination, platform connections may be disabled and data will be handled under our Privacy Policy and retention procedures.
12. Disclaimers
Qwik is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, specific creator performance, sales results, platform eligibility, or continued availability of any third-party API or feature.
13. Limitation of liability
To the maximum extent permitted by law, Point One Percent LLC and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from use of Qwik. To the extent liability cannot be excluded, aggregate liability will not exceed the greater of amounts paid to Qwik for the affected service during the twelve months before the event giving rise to the claim or USD $100.
14. Indemnification
To the extent permitted by law, you agree to defend and indemnify Point One Percent LLC from third-party claims arising from your unlawful use of Qwik, your violation of these Terms, your misuse of platform data, or your infringement of another party’s rights.
15. Changes
We may update these Terms as our product or legal obligations change. If a change materially reduces your rights, we will provide notice where required by law. Continued use after an updated effective date constitutes acceptance to the extent permitted by law.
16. Governing terms
These Terms are governed by the laws applicable to Point One Percent LLC, without regard to conflict-of-laws principles, except where mandatory law provides otherwise. Any dispute must be brought in a court with lawful jurisdiction over the parties and dispute.
